Booking Terms & Conditions

These Terms & Conditions (“Terms”) govern all bookings for retreats organised by Tashi Dawa Yoga (“the Retreat Organiser”, “we”, “us”, “our”). By submitting a deposit or booking, the person booking (“the Retreat Guest”, “you”, “Guest”) agrees to be bound by these Terms.

Definitions

“Retreat” means the yoga retreat, accommodation, and meals advertised and booked through Tashi Dawa Yoga. “Retreat Guest” means any individual booked to attend the Retreat. “Retreat Organiser” means Tashi Dawa Yoga, operated by Tashi Dawa as a sole trader with no employees, together with any contractor or work-exchange helper she personally engages and directs to assist with or deliver the retreat (such as a substitute teacher under “Changes to Advertised Programme” below, or a helper assisting with retreat logistics in exchange for retreat participation). It does not include independent third-party providers such as the venue, caterers, massage therapists, or tour operators – see “Third-Party Providers” below.

Booking Confirmation

A booking is confirmed, and these Terms become binding on both parties, once the non-refundable deposit set out below has been received by the Retreat Organiser. Full payment of the balance is required to complete your place as set out in “General Payment Guidelines” below, but the contract between you and the Retreat Organiser exists from the point the deposit is paid – not only once paid in full.

Scope of the Retreat

The retreat programme organised and provided by the Retreat Organiser consists of yoga sessions, accommodation, and meals, as set out in the specific retreat description advertised at the time of booking. The Retreat Organiser does not organise, arrange, supervise, lead, or include hiking, walking, swimming, water sports, excursions, or any other on-site or off-site activity as part of the retreat, unless expressly stated otherwise in the description for a specific retreat.

Any such activity undertaken by a Guest during their stay – whether on the retreat property or elsewhere, during free time or otherwise – is undertaken entirely at the Guest’s own initiative and risk. It is not organised, arranged, or supervised by the Retreat Organiser, and is not the Retreat Organiser’s responsibility.

Third-Party Providers

The retreat venue, any catering arranged separately from the venue, massage therapists, and any other wellness or service providers made available during the retreat, are independent businesses or practitioners. None of them are employees or contractors of the Retreat Organiser, and none of them act on the Retreat Organiser’s behalf. Tours or excursions arranged in connection with the retreat, even where facilitated or recommended by the Retreat Organiser, are likewise operated by independent third-party providers.

Where a Guest chooses to use a service offered by one of these independent providers, that is a separate arrangement between the Guest and the provider. The Retreat Organiser assumes no responsibility or liability for the acts, omissions, quality, or safety of services provided by these independent providers – including food preparation and safety, massage or bodywork, accommodation, transport, and tours — except to the extent caused by the Retreat Organiser’s own negligence (for example, in selecting a provider, or in passing on dietary requirements or health information a Guest has notified to the Retreat Organiser).

Guests must notify the Retreat Organiser of any dietary requirements, allergies, or relevant health conditions prior to the retreat start date, so these can be passed on to the venue, caterer, or other provider where relevant. The Retreat Organiser cannot guarantee that an independent provider will be able to accommodate all requirements.

Travel Insurance

Retreat Guests are strongly advised to obtain comprehensive personal travel insurance prior to attending the retreat. Such insurance should provide cover for the yoga sessions included in your booking, as well as any optional activity you choose to undertake during your stay (such as walking, swimming, water sports, hiking, or excursions – see “Scope of the Retreat” above), unexpected travel delays, cancellations, illness, loss or damage to personal property, and other standard travel risks.

Guests are requested to carry a copy of their insurance policy and make it available to the Retreat Organiser upon request in the event of an emergency.

Health & Medical Disclosure

Retreat Guests must disclose to the Retreat Organiser, prior to the retreat start date, any pre-existing medical condition, injury, or disability that may affect their ability to safely participate in retreat activities (including yoga, hiking, swimming, or water sports). The Retreat Organiser may request written medical clearance before confirming or continuing a booking, and reserves the right to reasonably restrict a Guest’s participation in specific activities where undisclosed or disclosed conditions present a safety concern.

Risk Warning (New South Wales)

This section is a risk warning for the purposes of section 5M of the Civil Liability Act 2002 (NSW). The retreat, including yoga sessions and associated physical movement, is a recreational activity that carries inherent and significant risks, including but not limited to the risk of physical injury from falls, muscle strain, sprains, joint injury, or other exertion-related injury. These risks exist even where all reasonable care is taken by the Retreat Organiser and its instructors. By booking a place on the retreat, the Retreat Guest acknowledges having received this warning before participating.

Limitation of Liability

Retreat Guests must be physically and mentally capable of participating in all retreat activities. Each Guest participates in the retreat and all associated activities entirely at their own risk and accepts personal responsibility for their safety during travel, transfers, yoga, walking, hiking, swimming, and general movement within and around the retreat property.

Guests are responsible for any damage or injury caused by their actions to themselves, to others, or to property, including the buildings, fixtures, furnishings, and equipment of the retreat venue.

The Retreat Organiser accepts no liability for the loss of, damage to, or theft of personal belongings, except where caused by the Retreat Organiser’s negligence. The Organiser is not responsible for the recovery or return of personal items left behind at the retreat property.

By participating in the retreat, each Guest agrees to release and hold harmless the Retreat Organiser and any contractor or helper it engages from liability claims arising from participation in the retreat, to the fullest extent permitted by law.

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation, including in respect of death or personal injury caused by the negligence of the Retreat Organiser or any contractor or helper it engages. Where liability cannot lawfully be excluded, it is limited (to the extent the law permits) to the resupply of the relevant service.

Code of Conduct

All individuals attending the retreat, including guests and the Retreat Organiser, have the right to feel safe and free from harm, harassment, or aggression.

Where a Guest disrupts the peace, behaves disrespectfully towards others, or fails to uphold the respectful atmosphere of the retreat, the Retreat Organiser may, at its reasonable discretion and typically following a verbal warning where practical, request that the Guest leave the premises. In such cases, retreat fees already paid will be forfeited and no refund will be issued.

Minors

The minimum age for participation in the retreat is 16 years, unless otherwise agreed in advance with the Retreat Organiser. Any Retreat Guest under 18 years of age must have a parent or legal guardian countersign the Retreat Guest Agreement and General Waiver below on their behalf before the minor’s booking will be confirmed; a minor’s own signature alone is not sufficient to bind them to these Terms.

General Payment Guidelines

As retreats accommodate a limited number of guests, all reservations must be accompanied by a non-refundable deposit (see “Deposit” below). The balance payment is due no later than 60 days prior to the commencement of the retreat.

Deposits are charged per person; a separate deposit must be paid for each individual included in the booking.

Bookings made within 60 days of the retreat start date must be paid in full at the time of booking.

Cancellation, Change & Refund Policy

Deposit

A non-refundable deposit of €400 is required to secure your place. Should the Retreat Organiser successfully fill a vacated place following a cancellation, the deposit will be refunded to the original Guest less a €100 handling fee.

Transfer of Booking

The booking may be transferred to another guest prior to the commencement of the retreat, subject to prior discussion and written agreement with the Retreat Organiser. If the Retreat Guest sources a replacement themselves, all financial arrangements between the original and replacement guest are the responsibility of those parties, and no handling fee is charged by the Retreat Organiser in this case.

Cancellations by the Guest

Once the retreat balance has been paid, the following credit policy applies:

• Cancellations made 60 days or more before the retreat start date will receive a 75% credit of retreat fees paid (excluding the deposit) towards a future retreat.
• Cancellations made between 31 and 59 days before the retreat start date will receive a 50% credit of retreat fees paid (excluding the deposit) towards a future retreat.
• Cancellations made within 30 days of the retreat start date are non-refundable, unless the vacated place is successfully filled by another guest, in which case the Deposit clause above applies.

Credit issued under this policy is valid for 12 months from the original retreat start date, may be applied to any future Tashi Dawa Yoga retreat, and is non-transferable to another person unless otherwise agreed in writing with the Retreat Organiser. Credit not used within this period will be forfeited.

Cancellations by the Organiser

In the unlikely event that the Retreat Organiser cancels the retreat for reasons within its reasonable control, all payments made, including the deposit, will be fully refunded.

Where the Retreat Organiser cancels or is unable to proceed with the retreat due to circumstances beyond its reasonable control (including but not limited to natural disasters, extreme weather, pandemic, civil unrest, or venue unavailability), the Retreat Organiser will offer Guests the choice of a full credit towards a future retreat or a refund of amounts actually recoverable from third-party suppliers (such as the venue and vendors), less any costs already incurred and non-recoverable by the Retreat Organiser.

Other Considerations

Guests booking one bed in a twin-share room will be paired with another guest of the same gender, unless alternative arrangements have been mutually agreed.

Travel to and from the retreat venue, including airport transfers, remains the responsibility of each guest. Group transfers may be facilitated by the Retreat Organiser for convenience only; such arrangements are made directly between the guest and the transport provider. The Retreat Organiser acts solely as a point of contact and assumes no liability for any agreement, service, or incident arising from third-party transport.

A reasonable level of physical fitness is required to participate in retreat activities.

Payment Method & Fees

Your place is confirmed once the deposit set out above is received; full payment of the balance is required by the due date to retain your place and complete your booking.

The Retreat Organiser does not store credit card details and does not use or share your personal information for marketing purposes. Passport copies are required from all Retreat Guests to facilitate check-in at the retreat venue and are shared only with the relevant accommodation provider for that purpose, as required by local law – see “Data Protection & Privacy” below.

Apart from the security deposit, Credit Card or PayPal payments are available upon request and are subject to a 4% transaction fee, which will be added to the retreat balance.

Bank transfers are preferred to minimise transaction costs. Transfers are accepted in multiple currencies, and the Retreat Guest is responsible for all currency conversion and transfer fees.

Any applicable tourist taxes may be collected in cash by the retreat venue and remain the responsibility of the Retreat Guest.

Data Protection & Privacy

The Retreat Organiser collects personal information (including passport copies, contact, health, and payment details) solely to administer your booking, facilitate check-in, and ensure your safety during the retreat. This information is retained only for as long as reasonably necessary for these purposes and applicable legal or accommodation requirements, and is shared only with third parties directly involved in delivering the retreat (such as the accommodation provider), or where required by law. Guests may request access to, correction of, or deletion of their personal information by contacting the Retreat Organiser directly.

Changes to Advertised Programme

The Retreat Organiser reserves the right to modify, amend, or cancel any part of the advertised retreat programme as reasonably necessary, and will notify Guests of any material change as soon as practicable.

In particular, if Tashi Dawa is unable to teach or lead all or part of the retreat due to illness, injury, or another circumstance beyond her reasonable control, the Retreat Organiser reserves the right to bring in a suitably qualified replacement teacher or facilitator to deliver the affected sessions, so that the retreat can proceed as planned. This does not entitle the Guest to a refund, credit, or cancellation under this policy, as the retreat itself is not being cancelled.

Tours, excursions, and other third-party services are addressed in “Third-Party Providers” above.

Retreat Guest Agreement

By agreeing to this Retreat Guest Agreement, the participant releases the Retreat Organiser and any contractor or helper it engages from responsibility and liability arising from participation in the retreat, to the fullest extent permitted by law and subject to the “Limitation of Liability” section above.

The Retreat Guest agrees as follows:

“I am responsible for my own personal safety, health, and mental, physical, emotional, and general well-being during and after the Retreat. I release Tashi Dawa as the seminar leader, and the Retreat Organiser and any contractor or helper it engages, from liability for injuries or damages, whether mental or physical, that I may incur during the Retreat, except to the extent caused by their negligence. I hold the Retreat Organiser harmless for anything that might happen to me or to my possessions during the Retreat, other than as a result of the Retreat Organiser’s negligence. I understand that no health or travel insurance is provided by the Retreat Organiser, and that I am solely responsible for arranging my own insurance coverage. I have read and understand this Retreat Guest Agreement.”

(For Guests under 18: this Agreement must also be signed by a parent or legal guardian.)

General Waiver

The Retreat Guest agrees to indemnify and hold harmless the Retreat Organiser from claims, losses, damages, injuries, liabilities, and expenses (including reasonable legal fees) arising from or in connection with participation in the retreat, except to the extent caused by the negligence of the Retreat Organiser.

By agreeing to this Retreat Guest Agreement, the participant waives any right to hold the Retreat Organiser or its representatives liable for loss, injury, or damage, including but not limited to:

1. Changes or delays in flight schedules, missed connections, or other disruptions to travel services.
2. Injury, loss, or damage to persons or property, including luggage and valuables, other than as a result of the Retreat Organiser’s negligence.
3. Additional costs arising from changes in currency exchange rates, tariffs, tour prices, or schedules.
4. Defects in any vehicle, or the act, omission, or default of any third-party company or individual engaged in providing transport or other retreat services.
5. Additional expenses or losses caused by illness, adverse weather, civil unrest, industrial action, natural disasters, acts of God, war, terrorism, pandemics, border closures, or any other events beyond the reasonable control of the Retreat Organiser.
6. Losses resulting from cancellations, delays, or alterations to the retreat or associated services, other than as set out in “Cancellations by the Organiser” above.

Nothing in this General Waiver excludes or limits any liability, guarantee, right, or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation, including for death or personal injury caused by the negligence of the Retreat Organiser.

Governing Law & Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. Any dispute arising from these Terms or your participation in the retreat will be subject to the non-exclusive jurisdiction of the courts of New South Wales, Australia.

Severability

If any provision of these Terms is found by a court or tribunal to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with the Retreat Guest Agreement, constitute the entire agreement between the Retreat Guest and the Retreat Organiser regarding the retreat, and supersede any prior discussions or representations, except in the case of fraud or misrepresentation.
